The CEO of the Open Invention Network issued a formal statement today regarding the Microsoft CEO's recent claims about alleged Linux patent infringement.


...."“Unfortunately, embedded in Microsoft's recent endorsement of Linux are claims regarding customers’ needing protection from patent attack. Those claims are baseless.  In fact, there have been no patent suits against Linux.  While patent disputes are not unheard of between and among software developers and distributors, they are almost always resolved between these commercial entities – not by dragging in end-user customers. It was interesting that Ballmer would come out and accuse Linux of using Microsoft's "intellectual property."  Since the kernel and nearly all distro sources are open, and since MS is a closed-source shop, it seems all the more likely that MS has utilized some of the FLOSS community's un-patented "intellectual property."
